Conquorum Terms of Use
- Conquorum is a noticeboard. We don't organise, run, supervise, check or insure any activity, and we don't vet the people who post or join them.
- You must be 18 or over.
- Every activity you post or join must be lawful where it takes place. It's your job to check, and to get any permission, permit, licence or insurance it needs.
- You take part at your own risk, as far as the law allows.
- Activities, their locations and your display name are public.
- Report anything unlawful or unsafe. In an emergency call 999 (UK), 911 (USA and Canada) or 112 (Europe).
1. Who we are
Conquorum (conquorum.com) is operated by Tamberine.org ("Tamberine", "we", "us"), based in Scotland, United Kingdom. You can contact us at hello@conquorum.com.
These terms are an agreement between you and us. They sit alongside the Tamberine Terms of Use, which apply to your Tamberine account generally. If the two conflict on anything to do with Conquorum, these terms apply.
2. Accepting these terms
You can browse Conquorum without an account. Before you post an activity, say you're going, accept an invitation or invite others, we ask you to confirm you are 18 or over and to tick that you agree to these terms. By doing so, or by otherwise using Conquorum, you agree to them. We keep a record of the version you accepted and when.
If you don't agree, please don't post or take part in activities.
3. Who can use Conquorum
- You must be 18 or over to post, join or invite people to activities. Activities are for adults; please don't bring anyone under 18 unless the organiser has clearly said the activity is family-friendly. You are then fully responsible for their supervision and safety.
- You must sign in with your own account, give us accurate information, and not pretend to be someone else.
- You must not use Conquorum if we have removed or banned you, or if you're prohibited from doing so by law, including by any court order that restricts your contact with others.
4. What Conquorum is (and isn't)
- Conquorum is a platform that lets members publish activities and find others to take part. Activities are organised by members, not by us.
- We are not the organiser, host, operator, promoter, employer, agent, insurer or supervisor of any activity. We are not a party to any arrangement between members.
- We do not check that activities are lawful, safe, suitable, accurately described or will go ahead. We do not check members' identity, background, criminal record, qualifications or fitness, or locations, routes or venues.
- Distances, map pins, directions and postcode look-ups are approximate and for convenience only. Check the location yourself before you go.
5. Compliance with the law
Every activity posted on, and every activity taken part in through, Conquorum must comply with all laws, regulations, bylaws and official requirements that apply where the activity takes place and to the people taking part ("Applicable Law").
When you post, join or invite others to an activity, you confirm and promise that:
- the activity, and your participation in it, complies with Applicable Law. That includes the law of the country, region and local area where it takes place, and of anywhere you travel through to get there;
- you have checked whether the activity needs any permission, permit, licence, consent, notification, risk assessment or insurance. This includes landowner or venue permission, event or road-closure permits, alcohol, entertainment, gambling or food licences, and any requirements of national parks, local authorities or the police. Where it does, you, as organiser, have obtained it before the activity takes place;
- in Scotland, access to land and water follows the Scottish Outdoor Access Code, and elsewhere you follow the equivalent rules and rights of way;
- you will follow any lawful instruction from the police, emergency services, land managers, venue staff or other authorities;
- you will not use Conquorum to arrange, promote or take part in anything illegal, or to help anyone else do so.
You are solely responsible for knowing and following Applicable Law. We don't give legal advice. If you're unsure whether an activity is lawful or needs permission, don't post or take part until you've checked with the relevant authority.
6. Activities that aren't allowed
You must not post, promote or take part in any activity through Conquorum that:
- is unlawful, or involves illegal drugs, weapons, trespass, unlicensed alcohol sales, unlicensed gambling, or breaches of public order or road traffic law;
- is dangerous beyond the normal risks of the activity, or encourages reckless behaviour;
- is sexual or adult in nature, or is a dating or escort service;
- involves or targets children, or isn't suitable for the people it invites;
- is hateful, harassing, discriminatory, threatening, or encourages violence or self-harm;
- is a scam, pyramid scheme, multi-level marketing, or unauthorised commercial selling, fundraising or advertising (charging participants is only allowed where it's clearly stated, lawful, and only covers genuine costs such as venue hire);
- breaches anyone's rights, including privacy, intellectual property or contracts; for example, sharing a private address, or posting a venue's event without permission;
- is designed to collect people's personal information, or to find, follow or monitor someone.
7. If you post an activity
As the organiser, you also agree to:
- describe the activity, time, place and any costs, equipment, fitness or skill needed accurately and honestly, and keep them up to date;
- choose a public or suitable location you're entitled to use, and tell participants about any known hazards;
- delete the activity, or let people know, promptly if it's cancelled or changes;
- take reasonable care for the people taking part, and be aware that, depending on the activity, organisers can have legal duties of their own (for example under health and safety or occupiers' liability law). It's your responsibility to consider whether you need insurance;
- not charge for anything unless the price and what it covers are stated clearly in the description.
8. Safety and your own risk
Many activities, especially sport, fitness and outdoor ones, carry a risk of injury, illness, loss or damage. Meeting people you don't know also carries risks. To the fullest extent permitted by law, you take part in any activity voluntarily and at your own risk, and you are responsible for:
- deciding whether an activity is suitable for you, your health, fitness and ability. If in doubt, ask a doctor first;
- your own safety, equipment, clothing, travel, food, drink and belongings, and checking the weather and conditions;
- your own behaviour, and any harm you cause to others or to property.
Safety tips: meet in a public place, in daylight where possible; tell a friend where you're going and when you'll be back; travel there and home independently; don't share more personal information than you need to; trust your instincts and leave if you feel unsafe; and report anything worrying. In an emergency, call 999 (UK), 911 (USA and Canada) or 112 (Europe).
9. Your content and public information
- You keep ownership of what you post. You give us a non-exclusive, worldwide, royalty-free licence to store, display, adapt (for example resize or format) and distribute it, solely to run and improve Conquorum and Tamberine.
- Activities are public: anyone, signed in or not, can see an activity's title, description, time, location, categories and the organiser's display name. People who are signed in can see the display names of those going. Your saved contacts and the invitations you send or receive are private to you and the person concerned.
- Only post information you're entitled to share. Don't post anyone else's personal details without their permission.
- When you search by postcode, zip code or place name, what you type is sent to the free look-up services postcodes.io or OpenStreetMap Nominatim to find the location.
10. Reporting, moderation and removal
- Please use Report on any activity that breaks these terms, and Block to stop seeing someone's activities and invitations.
- We may, at our discretion and without notice, remove or hide any activity or content, and suspend or close any account, if we reasonably believe it breaks these terms or the law, or puts anyone at risk. We aren't obliged to monitor content, and we can't guarantee we'll catch everything.
- We may share information with the police or other authorities where the law requires it, or where we believe it's necessary to protect someone's safety or to prevent or detect crime.
11. Our liability
- Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under the law of Scotland or the law of the part of the UK where you live. It doesn't affect your statutory rights as a consumer.
- Subject to 11.1, and because Conquorum is provided free of charge:
- we provide Conquorum "as is" and "as available", without any promise that it will be uninterrupted, error-free, or that any activity or information on it is lawful, safe, accurate or suitable;
- we are not responsible for activities, or for the acts or omissions of members or anyone else, including organisers and participants, at, on the way to or from, or in connection with any activity. We are not responsible for any injury, illness, loss, damage, cost or claim arising from them;
- we are not liable for any loss that wasn't reasonably foreseeable, or for business losses (we provide Conquorum for domestic and private use only);
- our total liability to you for all claims in connection with Conquorum is limited to £100.
- Any dispute about an activity is between you and the other members involved.
12. Your responsibility to us
To the extent permitted by law, you agree to compensate us for any claims, losses, liabilities, fines and reasonable costs, including legal costs, that we suffer because you broke these terms or Applicable Law, or because of an activity you organised. This doesn't apply to losses caused by our own breach or negligence.
13. Maps and other services
Conquorum uses third-party services, including OpenStreetMap map tiles and look-ups, postcodes.io, and links that open Google Maps and Apple Maps. Their own terms and privacy policies apply when you use them, and we're not responsible for their accuracy or availability.
14. Changes and ending
- We may update these terms, for example to reflect changes in the law or to Conquorum. If a change is significant, we'll ask you to accept the new version before you next post or take part. The version and date are shown at the top of this page.
- You can stop using Conquorum at any time and delete your activities. We may change, suspend or withdraw Conquorum, in whole or in part, at any time.
- Sections 5, 8, 9.1, 11, 12 and 15 continue to apply after you stop using Conquorum.
15. Governing law and courts
These terms are governed by the law of Scotland, and the courts of Scotland have jurisdiction. If you live in England, Wales or Northern Ireland, you may also bring proceedings in your local courts, and you keep the benefit of any mandatory consumer protections of where you live.
If any part of these terms is found unenforceable, the rest still applies. If we don't enforce a term straight away, we can still enforce it later.
